These Terms of Service (“Terms”) form the agreement between Paradise Island LLC (“Stay in Culebra” or “StayinCulebra.com”), a Puerto Rico corporation (the “Company,” “we,” or “us”), and you (“you” or “Guest”), governing your use of our website (the “Site”) and the services we provide.

By using our Site, booking a property, or purchasing a service, you agree to these Terms as well as any additional rules, policies, or guidelines presented during the booking process. If you do not agree, you must not use our Site or Services.

Role of StayinCulebra.com

StayinCulebra.com is an online platform and marketplace. We do not own or operate the vacation rentals listed on our Site. These properties are individually owned and managed by independent Hosts. Likewise, tours, experiences, and other services are provided by third parties.

Our role is limited to:

• Facilitating listings and bookings for rentals, tours, and experiences.
• Acting as an intermediary in accepting and processing payments (via Stripe).

We are responsible for the platform, but not for the services themselves.

Guest Terms

Booking and Cancellations

When booking through StayinCulebra.com, you agree to:

• The applicable policies displayed during the booking process.
• Each Host or Service Provider’s cancellation and no-show policy.
• Our Refund & Cancellation Policy, summarized below:
  • 75% refund up to 10 days prior to arrival (minus Service Fee)
  • 50% refund up to 5 days prior to arrival (minus Service Fee)
  • No refund within 5 days of arrival or after check-in
  • The StayinCulebra.com Service Fee and Cleaning Fees are non-refundable

If you arrive late or check out early, unused nights are non-refundable. Extenuating circumstances (e.g., natural disasters, government restrictions, declared emergencies) may override these policies.

StayinCulebra.com and Paradise Island LLC reserve the right to cancel or substitute reservations if circumstances beyond our control arise. In such cases, every attempt will be made to relocate you to a comparable property.

Guest Responsibilities

By booking, you agree to:

• Treat the property and Host’s staff with respect.
• Avoid causing damage, nuisance, or inappropriate behavior.
• Contact your Host if you expect to arrive late to avoid cancellation or penalties.
• Pay all charges, including applicable taxes and fees.

Property Safety & Child Supervision Notice 

Our properties are located in a natural island environment and may include features such as:

• Nearby ocean access and beaches

• Hills, steep driveways, and uneven terrain

• Stairs, elevated balconies, terraces, and railings

• Open outdoor areas not designed for childproof safety

For this reason:

• These properties are not recommended for children under 12 years old

• Adult supervision is required at all times for all minors

• Properties are not child-proofed

• We do not provide cribs, playpens, high chairs, baby gates, outlet covers, or toddler safety equipment

By booking, guests acknowledge and accept that:

• The island environment carries natural safety risks

• They assume full responsibility for the supervision and safety of minors

• Paradise Island LLC / Stay In Culebra is not liable for accidents resulting from lack of supervision or misuse of property features

Payments

• Payments are processed securely through Stripe, a third-party payment provider.
• We do not store your credit/debit card details.
• Your Host may require full or partial payment upfront.

Puerto Rico Room Occupancy Tax

• A 7% Room Occupancy Tax applies to all stays of 89 nights or less, including cleaning fees.
• StayinCulebra.com collects and remits this tax in compliance with Puerto Rico law.
• If the government modifies the rate or applicable period, we will adjust accordingly.

Extenuating Circumstances

Full or partial refunds may apply in the event of:

• Government travel restrictions or changes in entry requirements
• Declared local or national emergencies (including pandemics)
• Military actions or hostilities
• Natural disasters

Documentation may be required for claims under this policy.

Additional Terms

• StayinCulebra.com is not a party to rental or service agreements between Guests and Hosts. We provide the platform but do not guarantee the adequacy, safety, or quality of properties or experiences.
• Member Content: Any content shared by Hosts or Guests (listings, reviews, photos) is their responsibility. We are not liable for accuracy or suitability.
• Marketing Support: We may provide recommendations, but we assume no responsibility for the outcome of bookings or experiences.

Limitations of Liability

To the maximum extent permitted by law:

• Guests assume all risks related to stays, tours, and experiences booked through the Site.
• Hosts assume all risks related to providing accommodations, tours, or experiences.
• StayinCulebra.com is not liable for losses, damages, or disputes arising from use of the platform, interactions between Guests and Hosts, or Member Content.

By using StayinCulebra.com, you acknowledge and agree to these Terms of Service & Policies.
