Policies & Terms of Service
These Terms of Service (“Terms”) comprise the agreement between Paradise Island LLC (“Stay in Culebra” and “StayinCulebra.com”), a Puerto Rico Corporation (the “Company,” “we” or “us”), and you or the entity you represent (collectively, “you”), governing your use of this website (the “Site”) and all of the services that it provides, as described below. In addition, you acknowledge and agree that you shall also be subject to any posted rules or guidelines that may be applicable to our Site or Services, which may contain terms and conditions in addition to those in these Terms of Service. In case you do not agree to these Terms, do not access the website or any of the services it provides.
StayinCulebra.com does not own the properties that comprise the Vacation Rentals listed on its Site. Such properties are individually owned, and they are rented and operated by a Host who manage and offer them. Experiences, Tours, Adventures, and other Services are provided by third parties. We simply provide the online platform and marketplace to facilitate the listing and booking of vacation rentals, tours, experiences and other services, and act as an intermediary in accepting and processing payments with respect to such short term rentals, tours, experiences and other services.
GUEST TERMS
When you complete your booking through StayinCulebra.com, you accept these Terms and any other ones that you are provided with during the booking process.
StayinCulebra.com/Paradise Island LLC provides a Short Term Rental Platform, although we take great care of our platform, we can’t guarantee that everything on it is accurate, we obtain information from the Service Providers/Property Owners. To the extent permitted by law, we can’t be held responsible for any errors, any interruptions, or any missing bits of information, though we will do everything we can to correct/fix them as soon as we can.
StayinCulebra.com is responsible for the Platform, but not the booking experience itself.
Booking through our platform
When booking through StayinCulebra.com, you accept the applicable policies as displayed in the booking process. You’ll find each Service Provider’s cancellation policy and any other policies on our Platform, on the Service Provider listing pages, during the booking process, also in the fine print, and/or in the confirmation email.
Any cancellation/no-show fee or refund will depend on the Host/Service Provider’s cancellation/no-show policy. Service Fee is non-refundable.
If the guest arrives and decides to leave early, the nights not spent after the official cancellation are non-refunded. Cleaning fees, Service fees, Additional Guest fees are non-refundable.
Some Bookings can be canceled for free, while others can only be canceled for free before a deadline.
You agree to not cause any nuisance or damage, and not behave inappropriately to the Service Provider’s property and/or personnel (or anyone else, for that matter).
Contact your Host/Service Provider if you think you will arrive late to your tour, experience, and/or lodging to avoid any cancellations on your bookings. If you’re late to any of the services provided by our hosts, we are not liable for the consequences (e.g. the cancellation of your booking or any fees the Host/Service Provider may charge).
When you make a booking though StayinCulebra.com, you agree to pay the cost of the stay, tour and experience, including any taxes and charges that may apply.
Payments
Your host/service provide might require an upfront payment and/or a payment taken upon your check-in to your lodging and/or tour and experience.
Please note that StayinCulebra.com does not store your credit/debit card number or personal information when you make a payment.
StayinCulebra.com process all payments though our third party payment service provider, Stripe. Stripe is one of the largest and most secure payment processing companies in the world.
Puerto Rico Room Occupancy Tax
StayinCulebra.com will collect and remit Room Occupancy Tax on all Puerto Rico bookings and reservations of 89 nights or less (the “period”), completed on the StayinCulebra,com site. Should said period be modified by the Puerto Rico government at any time, it will be changed in compliance with local law. When booking, all Guests will see a separate charge for Room Occupancy Tax, which will be added to the total amount they pay for their booking or reservation. Guests will pay a Room Occupancy Tax of 7% calculated from the total amount to be paid for the rental stay (including cleaning fees), for reservations of 89 nights or less. Should the Room Occupancy Tax be modified by the Puerto Rico government at any time, said modified rate will be charged in compliance with local law.
Cancelation Policy
75% refund 10 days prior to arrival, except Service Fee
The Stayinculebra.com Service Fee, which covers administrative fees, is non-refundable.
Guest will receive 75% refund minus Service Fee.
To officially cancel a reservation, the guest will have to click the cancellation button on the cancellation confirmation page, which they can find in Dashboard > Your Trips > Change or Cancel.
If a guest decides to check out early, the nights not spent will not be refunded.
Cancellation policies may be superseded by the Guest Refund Policy, safety cancellations, or extenuating circumstances. Please review these exceptions.
There will be no refund if Guest decides to cancel after Check-in.
Applicable taxes will be retained and remitted.
Extenuating Circumstances:
- Changes to government travel requirements
- Travel restrictions imposed by a governmental agency
- Government declared local or national emergencies, epidemics, pandemics, and public health emergencies
- Military actions and/or hostilities
- Natural disasters
StayinCulebra.com and Paradise Island LLC reserves the right to cancel any reservations, or substitute rental units due to circumstances beyond our control. Should the unit confirmed by guest become unavailable for any reason whatsoever, The Host will inform guest prior to check in and every attempt will be made to relocate guest to a comparable unit.
Additional Terms
StayinCulebra.com does not own, rent, operate operate or provide the properties or experiences that comprise the properties listed on its Site. Such properties and experiences are owned, rented, operated and/or provided by the Hosts who offer them. We simply provide the online platform and marketplace to facilitate the listing and bookings, and act as an intermediary in accepting and processing payments with respect to such properties
StayinCulebra.com/Paradise Island LLC main purpose is to provide quality Site and Services to connect its Members as described above. Consequently, StayinCulebra.com/Paradise Island LLC does not respond for or guarantee any activity generated by its Members while utilizing its Site and Services, including, but not limited to, (i) the Member Content that they create, acquire and share on the Site, (ii) the adequacy, quality and suitability of the properties or services that Members may offer, or (iii) the interactions and disposition of its Members while transacting and/or communicating through the Site.
Any agreement entered into between a Guest and a Host with respect to the booking and performance of a StayinCulebra.com is between such Guest and Host. We are not a party to and assume no responsibility for any such agreement. We simply provide the platform and marketplace to facilitate the listing and booking of StayinCulebra.com and act as an intermediary in accepting and processing payments with respect to short-term rentals and services.
Limitations of Liability (Guest and Host)
As a Guest, you acknowledge and agree that, to the maximum extent permitted by law, you assume all risk and responsibility arising out of your access to and use of the StayinCulebra,com Site and Services, your review and use of any Listings via the StayinCulebra,com Site and Services, your transactions with any Host, your stay at any Property, your participation in any Tour, Adventure and Experience or use of any other Service, or any other interaction you have with other Members whether in person or online.
As a Host, you acknowledge and agree that, to the maximum extent permitted by law, you assume all risk and responsibility arising out of your access to and use of the StayinCulebra,com Site and Services, your publishing or booking of any Listing via the StayinCulebra,com and Services, the stay of Guests at your Property, participation by any Guest in any of your Adventure, Tour and Experience, use by Host of any other of your services, or any other interaction you have with other Members whether in person or online.
Members will at all times assume all risk and be responsible for the use, review, publishing and all content of any and all applicable Listings, requests for acceptance and confirmation of all Bookings, acceptance and confirmation of all Bookings, as applicable to Guest and Host. StayinCulebra.com may, upon a Member’s request or at its own initiative, provide marketing support and give recommendations in connection therewith. However, StayinCulebra.com assumes no risk nor responsibility for any Listing, including its content, request for acceptance and confirmation of any Bookings by Guest, acceptance and confirmation of any Booking by Host, nor the use and experience of any event connected with the use of StayinCulebra,com.
